Terms and Conditions

PERU RESERVATIONS E.I.R.L.

By making a reservation through any channel (website, email, social media, WhatsApp, or in person) with PERU RESERVATIONS E.I.R.L., the client automatically and fully accepts all terms and conditions described below. Please read carefully before proceeding with any payment.

General Provisions

By confirming your reservation with PERU RESERVATIONS E.I.R.L. (hereinafter referred to as "the Company"), the customer (hereinafter referred to as "the Passenger" or "the Client") expressly and irrevocably declares that they have read, understood, and accepted in their entirety the terms and conditions described herein, which govern the contractual relationship for the provision of tourist services.

The Company reserves the right to update or modify these terms at any time without prior notice. Clients are advised to review them periodically. If the client does not raise an explicit objection after receiving the booking documentation, it is assumed that they agree with all terms.

Booking Process and Confirmation

Booking Confirmation

A reservation is considered 100% confirmed only when the client receives a written confirmation (email) from Peru Reservations, after verification of the corresponding payment.

Data Accuracy

It is the sole responsibility of the client to ensure that all information provided is correct and matches exactly with their official travel documents. The data required to complete a booking includes:

  • Full name (exactly as it appears on your passport)
  • Passport or ID number
  • Gender
  • Nationality
  • Date of birth

Shared Responsibility

All persons included in a reservation are bound by this agreement. The person making the reservation acts as a representative of all included participants, accepting these terms and conditions on behalf of all of them.

Personal Data Protection and Privacy

In accordance with the Peruvian Personal Data Protection Law (Law No. 29733), the Company acts as the controller of the personal data provided by the Passenger. This information will be used confidentially and exclusively for the following purposes:

  • Management, processing, and confirmation of the reservation.
  • Operational and logistical coordination with suppliers.
  • Communication related to the contracted service.
  • Billing and issuance of payment receipts.

The Passenger may exercise their rights of access, rectification, cancellation, and opposition (ARCO) by contacting us through our official channels. For further details, please refer to our complete Privacy Policy on our website.

Deposits and Payment Policy

Initial Deposit

To confirm any service, a non-refundable initial deposit is required. The deposit amount depends on the type of service booked:

This deposit is 100% non-refundable and non-transferable under any circumstances, including medical emergencies, as it is used immediately for the purchase of permits, entrance tickets, train tickets, hotel reservations, and other services with suppliers.

Outstanding Balance

The remaining balance must be paid in full at least 48 hours before the tour start date. The traveler will not be able to start the tour without having completed the full payment. Failure to settle the balance within the specified timeframe may be considered a cancellation by the client and will be subject to the penalties outlined in Section 7.

Payment Methods and Fees

  • Cash: US Dollars or Peruvian Soles (in office only, at the day's exchange rate). Torn, ripped, or damaged bills are not accepted.
  • Credit/Debit Card: A 5% service charge applies.
  • PayPal: An 8% service charge applies.
  • Bank Transfer (WeTravel): US Checking Account with no additional charge.

All bank fees or transaction charges generated are the sole responsibility of the client.

Currency and Pricing

All quoted prices are in US Dollars (USD). Payments made in other currencies (e.g., Peruvian Soles - PEN) will be calculated using the interbank exchange rate published by the SBS (Superintendency of Banking, Insurance, and AFP) on the transaction date. Prices are per person and may be subject to adjustments due to changes in taxes, government fees, or fuel surcharges, which will be communicated in a timely manner.

Itineraries and Operational Modifications

Our itineraries are designed as a travel guide. PERU RESERVATIONS E.I.R.L. reserves the right to modify the order of excursions, accommodations, or routes for operational, logistical, force majeure reasons, or to optimize the traveler's experience, while always ensuring that all included services are provided.

Train routes and schedules are subject to availability from railway companies (PeruRail, IncaRail). The itinerary may be adjusted as necessary. The Company commits to informing the client of any significant changes as far in advance as possible.

Date Changes

Date changes are subject to a minimum penalty of US$200.00 per person. The final amount may vary depending on the tour booked.

This penalty exists because the original tickets (Machu Picchu, trains, etc.) are forfeited and non-refundable. The penalty covers the acquisition of new tickets.

If the booking includes additional tickets (Huayna Picchu, Machu Picchu Mountain, Huchuy Picchu, or other upgrades), an additional penalty corresponding to those services will apply.

Tickets for Machu Picchu, trains, and other destinations are non-refundable and non-transferable.

Cancellation Policy

All cancellation requests must be submitted in writing (email) through our official channels, by the same person who made the reservation.

42+ Days Before

60% Retained

60% of the total tour cost is retained. The remaining 40% is refunded.

14 - 41 Days Before

80% Retained

80% of the total tour cost is retained. The remaining 20% is refunded.

7 Days or Less

100% Retained

No refund is issued. 100% of the total tour cost is retained.

Non-Refundable Services (No Exceptions)

Certain services, due to their nature of immediate issuance and supplier policies, are non-refundable under any circumstances:

  • Inca Trail permits and Machu Picchu entrance tickets
  • Train tickets (PeruRail, IncaRail)
  • Domestic and international flight tickets
  • Entrance fees to archaeological sites and national parks
  • Hotel reservations already confirmed with the supplier

These services are invoiced and paid to the provider immediately upon booking.

Service Interruption and Additional Considerations

Trek/Tour Abandonment or Interruption

If the client decides to abandon the trek or tour once it has started, no refund will be issued. All subsequent additional costs (meals, accommodation, alternative transportation) will be the sole responsibility of the client. The client may rejoin the group for the Machu Picchu tour on the last day, but additional expenses (e.g., train ticket) will be at their own cost.

Health Issues During the Tour

If the client is unable to begin or continue the trek/tour due to health problems, no refunds will be issued. Company staff will accompany the participant to the nearest emergency assistance. Evacuation costs (including helicopter) and medical treatment are the sole responsibility of the traveler. A formal illness certificate may be issued for travel insurance purposes.

Voluntary Non-Use of Services

No refund will be provided for services not used due to the Passenger's voluntary decision (e.g., choosing not to take a train, leaving a tour midway, not showing up for a briefing). Absences from briefings or the tour departure point are considered no-shows, with no right to a refund.

Force Majeure and Extraordinary Events

PERU RESERVATIONS E.I.R.L. shall not be held liable nor provide a full refund for interruptions, modifications, or cancellations of services due to circumstances beyond our direct control, including but not limited to:

Adverse weather conditions (torrential rains, landslides, snowfall)
Natural disasters (earthquakes, tsunamis, volcanic eruptions)
Social unrest (strikes, work stoppages, road blockades, protests)
Decisions or regulations imposed by governmental or health authorities (pandemics, quarantines, closures)

In Such Cases, the Company Commits to:

  • Rescheduling services if possible and mutually agreed upon with the client.
  • Seeking viable operational alternatives to fulfill the itinerary to the extent possible.
  • Offering an alternative route when the original route is not viable for safety reasons.

Pandemics or Global Events

If a service cannot be provided due to a pandemic or other global event, no refunds will be issued. An open ticket will be offered to use the service on an alternative date, subject to availability.

Note: Additional expenses incurred by the client (extra hotel nights, meals, replacement flight tickets) will not be covered by the Company, reinforcing the necessity of adequate travel insurance.

Passenger Responsibilities

The Passenger declares that they understand and accept the following:

Personal Information

It is their responsibility to provide accurate and complete personal information (full name as it appears on travel documents, date of birth, nationality, etc.) for the correct issuance of tickets and reservations.

Travel Documents

They must carry their original passport and/or identification document used for the reservation throughout the entire trip. The passport must have a minimum validity of 6 months beyond the travel date. If you renew your passport before the trip, you must inform us immediately and send a photo of both documents. It is the Passenger's responsibility to verify visa requirements and necessary documentation for entry into Peru.

Medical Certificate (70+ Years)

For passengers over 70 years of age participating in hiking and/or adventure tours (such as the Inca Trail, Salkantay, etc.), it is mandatory to present an updated medical certificate confirming good health and physical fitness, issued no more than 30 days prior to the tour start date. Any existing medical condition requires a medical certificate authorizing participation. If the certificate is not presented or relevant medical information is omitted, Peru Reservations may refuse to provide the service without a refund.

Travel Insurance - HIGHLY RECOMMENDED

The Company strongly recommends that the Passenger purchase comprehensive travel insurance covering, at a minimum: trip cancellation, medical assistance, emergency evacuation, medical repatriation, and lost luggage. PERU RESERVATIONS E.I.R.L. shall not be responsible for expenses incurred due to lack of insurance coverage.

Mandatory Medical Disclosure

All travelers must disclose pre-existing medical conditions, allergies, or health concerns at the time of booking. Pregnancy is considered a medical condition and must be disclosed when booking, requiring a medical certificate authorizing participation. Peru Reservations does not provide medical consultations or health advice. It is the client's responsibility to assess whether the trip is suitable for their physical condition.

Conduct and Behavior

The Company reserves the right to immediately suspend services, without any refund, if the Passenger shows signs of drunkenness, use of prohibited substances, disorderly conduct, or behavior that risks their safety, the safety of other passengers, the guide, or equipment. All expenses resulting from this suspension will be borne by the Passenger.

For Minors

It is mandatory to present the minor's identification document (ID or Passport). If the minor travels with one parent, with third parties, or alone, a notarized travel authorization from both parents, valid for no more than 90 days and permitting the minor to leave the country, is required. This document is mandatory for presentation to Peruvian immigration authorities. The Company is not responsible if the minor is prevented from traveling due to lack of this documentation.

Special Policies - Inca Trail

Inca Trail permits are personal, non-transferable, and non-refundable. No name changes or date changes are allowed after the permit has been purchased. These conditions are imposed by the Peruvian Government (Ministry of Culture), not by the agency.

If the Inca Trail is declared closed due to natural calamities, maintenance, or government order, Peru Reservations will offer an alternative trek of similar characteristics.

Student Discount

  • Applies to persons 17 years old or younger or students with a valid ISIC card under 25 years of age.
  • A copy of a valid passport and/or ISIC card is required at the time of booking.

Accommodation Conditions

Accommodation conditions included in our tours are as follows:

  • Standard rooms: Twin (two single beds) with private bathroom.
  • Double/matrimonial rooms: Available upon prior request at the time of booking.
  • Solo travelers: Will be paired with another traveler of the same gender. If a single room is desired, an additional charge applies.
  • Hotel upgrades: Upgrades to higher-category hotels are available with prior notice and additional cost.

Tour prices are based on shared accommodation for two persons, unless otherwise indicated.

Tour and Group Terms

  • Group size: Up to 12 participants per group. Tours are conducted in English and Spanish.
  • Walking pace: May vary according to the physical capabilities of the group. All participants are expected to maintain a reasonable pace.
  • Tips: Tips are voluntary but always welcomed for guides, cooks, porters, and drivers.
  • Transportation: All tours include return transportation to Cusco, unless otherwise indicated in the specific itinerary.

Limitation of Liability

PERU RESERVATIONS E.I.R.L. acts as an intermediary (tour operator) between the Client and the final service providers (hotels, airlines, railway companies, restaurants, etc.). Therefore, the Company shall not be held liable for injuries, personal damages, property loss, accidents, delays, irregularities, or expenses incurred resulting from acts, omissions, or negligence of such providers.

The Company ensures safety with qualified staff, but is not responsible for third parties, weather conditions, natural disasters, strikes, health issues, or loss of personal belongings.

Assumption of Risk

By booking with Peru Reservations, the client acknowledges and accepts the inherent risks of outdoor adventure activities, including natural factors, uneven terrain, altitude, animals, insects, and vegetation.

Peru Reservations' financial liability is limited to the total amount paid for the tour.

Right to Use Images

By participating in Peru Reservations tours, the client authorizes the use of photographs and videos taken during activities for promotional and marketing purposes, without financial compensation. If the client does not wish their images to be used, they must notify us by email before the start of the trip at info@peru-reservations.com.

Governing Law and Jurisdiction

These terms and conditions shall be governed by and interpreted in accordance with the laws of the Republic of Peru. For any dispute or discrepancy arising from the interpretation, execution, or breach of this contract, the parties expressly submit to the jurisdiction of the Courts and Tribunals of the city of Cusco, waiving any other jurisdiction that may otherwise apply.
